As the former chief economist for the U.S. Sentencing Commission
and having worked on the NICS system when I was at the U.S. DOJ, these new
charges against Hunter Biden are treating him more like others. It was clear
that Hunter Biden had violated more gun laws than he was originally being
charged with. A good example is a case from June, the same month that Hunter
Biden's plea agreement originally came out - a black woman in Virginia with no
criminal history facing jail for using marijuana while possessing a handgun and
making a false statement about her drug use in buying a gun. That is much more
typical of how these cases are handled. Many misinterpret the low rate of
prosecutions for NICS violations. The reason for the low rate of prosecutions
is that virtually all these cases are false positives.
